Terms and Conditions

1.    Interpretation
“Company” means Cusacks Trading Company Pty Ltd
“Customer” means the purchaser of the Goods
“Goods” means all goods sold
“Terms” means these terms and conditions of sale
Website” includes www.cusacks.com.au and any social media sites

2.    Acceptance
By using the Cusacks website, you acknowledge that you have read, understood and accepted the Terms.  The Terms in this website are subject to change.

3.    Application
These Terms apply to all contracts for the sale of Goods.
No amendment, alteration or cancellation is binding on Cusacks Trading unless confirmed by Cusacks Trading in writing
The customer acknowledges that no employee has any right to make a representation, warranty or promise in relation to the sale of Goods other than contained in these Terms.

4.    Payment and Pricing
Pricing will be confirmed upon order and is not subject to discount other than stated in the invoice.
A deposit of 20% is required upon order.
When a specific fabric is ordered, payment for the fabric is required at the time of deposit.
The balance of the payment is due upon arrival in the Cusack’s warehouse or delivery
Interest is payable on all overdue balances from the due date until payment.

5.    Delivery
Delivery fees are based on reasonable access.
Within 3 days of notification of availability of orders, delivery arrangements and payment is required unless specific arrangements have been made prior to this time.  Best endeavours will be untertaken to find a mutually agreeable delivery time.
If contact is not able to be established or goods not picked up within 28 days, the deposit will be retained by Cusacks and the goods resold.
Cusacks retains the right to charge storage on all goods that are not delivered or arrangements made within 1 week of delivery.

6.    Ownership
Ownership and title will not transfer until all funds are paid and cleared.

7.    Inspection
Goods are deemed to be accepted upon delivery unless the customer notifies Cusacks Trading Pty Ltd in writing within 48 hours of delivery that the Goods do not meet the specification ordered.  

8.    Cancellation
Orders cannot be cancelled or modified without the express consent of Cusacks Trading Pty Ltd.  If consent is given, the Customer is liable for all costs incurred in cancelling or modifying the order.

9.    Warranty
All Goods supplied are covered by the statutory warranty.

10.    Force Majeure
Cusacks Trading Pty Ltd will not be liable for breach of contract due to events beyond the company’s control.
